Cape man charged with aggravated battery with a deadly weapon

On Friday, April 5, around 3:45 a.m., Cape Coral Police responded to a call for service in reference to a disturbance with weapons at 2108 Northeast 33rd Terrace.

According to a CCPD press release, officers met with the victim who was invited to the Northeast 33rd Terrace by the female home owner after a night out. The victim was standing in the kitchen eating when Gordon Alton Smith, 42, who also lives at the home, allegedly approached the victim for an unknown reason.

Police said Smith became upset that the victim was in the residence and began yelling. Smith then reportedly told the victim that he was going to get a gun and then left the kitchen and returned with what was later identified as a black Titan .25 caliber handgun. Smith struck the victim in the face twice with the handgun.

The victim was then able to take the gun away from Smith and flee the house to call 9-1-1 for help, police said.

Upon arrival, a CCPD officer took possession of the handgun which was loaded with six rounds but had an empty chamber.

Smith was charged with aggravated battery with a deadly weapon and aggravated assault with a deadly weapon without intent to kill, according to the report.

He was transferred to Lee County Jail.
