| | Condo Associations Can Collect Unit Owners Rental IncomeJune 23, 2009 - Sylvia HeldrethSome condo owners have rented out their units to make some money. Some of these are not paying their own condo fees, despite the rent they have collected. A recent Florida court decision makes it easier for asociations to collect dues from owners of homes and condominiums who collect rent from tenants but aren't paying their own association fees. The judge ruled that associations can file a single "blanket" receivership order to go after multiple-unit owners and their rent payments to cover past-due fees. Associations are not only able to collect rent payments to cover overdue fees, but in some cases up to a year's worth of payments in advance. Is this fair? What do you think?
