Right to Smoke in Your own Home vs Others rights

A jury has found a homeowners association negligent for failing to resolve a secondhand smoke dispute between neighbors at a California condominium. After a five-week trial, Superior Court jurors awarded a family more than $15,000, finding the condo association and management failed to ensure the non-smoking family's right to the "quiet enjoyment" of their own unit. A bill is pending in the state legislature that would ban smoking in multiunit residences like condominiums. Smokers say that they should be able to smoke in their own homes.

more restrictions but the state still takes the settlement money and the tax but spends very little towards the medical costs or to help stop smoking

Perhaps, just like hotels, there should be a non-smoking floor. However, although I dislike the odor of smoke tremendously, I disagree that a homeowner that smokes has to bend over for one that doesn't.
