| | Condo Associations can file Receivership to collect from rented unitsMay 20, 2010 - Sylvia HeldrethSome condo owner have rented out their units to make some money. Some of these are not paying their own condo fees, despite the rent they have collected. A recent Florida court decision makes it easier for associations to collect dues from owners of homes and condominiums who collect rent from tenants but aren't paying their own association fees. The judge ruled that associations can file a single "blanket" receivership order to go after multiple-unit owners and their rent payments to cover past-due fees. Associations are not only able to collect rent payments to cover overdue fees, but in some cases up to a year's worth of payments in advance. Is this fair? What do you think?
